Michael Jordan Testifies He Felt No Fear of the Racing Body in Antitrust Trial

Michael Jeffrey Jordan, introducing himself formally in a Charlotte court on Friday, admitted that his drive to win and novelty within the sport emboldened his push for 23XI Racing to “challenge” Nascar over alleged violations of antitrust rules.

Financial Stakes and a Competitive Drive

The owner disclosed operational insights of his 23XI team, revealing he put in $40 million of his personal wealth into the Nascar Cup series team launched with partner Polk and longtime driver Denny Hamlin.

“It fell to someone to act,” Jordan stated in the Charlotte courtroom. “As a newcomer, I had no fear. I felt I could challenge Nascar in its entirety. I felt as far as the sport it needed to be looked at from a different view.”

The Core Dispute: Charter Agreements and Contract Pressure

At issue is the expiration of a 2016 deal where Nascar provided each team a franchise. This system mirrors other professional sports with independent franchises, such as the NBA’s Hornets or the Carolina Panthers. The agreement was due to end in 2024 when Nascar demanded teams renew their charters.

Jordan was on the witness stand for an hour and exited the courthouse to a media frenzy, with onlookers and reporters clamoring for a glimpse or a photo of the global icon.

Spearheading the Fight

23XI Racing is at the forefront of the push along with another racing team for Nascar to overhaul a business model Jordan said is breaking the law to keep two hands on the wheel.

For Jordan and and Heather Gibbs, who preceded Jordan, are events from September 2024. She recounted a frantic and emotional six hours where the sanctioning body informed teams they had to sign a charter agreement extension. This agreement consists of 112 pages detailing pay for chartered teams and a guaranteed entry in every race.

Choosing Litigation

Jordan explained that 23XI and Front Row Motorsports concluded their sole viable path was to decline to sign that extensive document and litigate the matter. All other teams agreed to the terms.

Jordan and co-owner Denny Hamlin approached Nascar about possible changes or extension options. Nascar refused to engage, according to his testimony.

The Bottom Line: Victory

But in the end, the pushback against what he saw as a unsustainable system was driven by the usual bottom line for Jordan: Success.

“Hamlin persuaded me getting a third driver improved our chances to win,” he said, sharing that he bought a third charter late in 2024 for $28m amid the legal dispute. “So I dove in.”

Heather Gibbs’ Testimony

Gibbs described her request for permanent charters, which she said a written letter to Nascar. She said the pressure of the signature deadline didn’t sit well.

She said, Joe Gibbs first attempted to call and persuade Nascar against forcing signatures, but CEO Jim France refused the appeal.

“Don’t do this to us,” Gibbs recounted was the message to Nascar’s executives. The response was, “Whether I have 20 charters, that’s what I have. If I have 30, that’s the number.”
